It’s common for consent orders or binding financial agreements (BFA's) to include a transfer of real estate from one party to another, often in exchange for a cash payment. Completion of the transfer usually takes place 30 or 60 days after the making of consent orders or execution of the binding agreement.
It usually makes sense to attend to the formalities associated with any real estate transfer at the same time as signing the application for consent orders or binding agreement. That way you won't need a settlement agent to finalise the transfer. We'll take care of it for you.
We offer a fixed price service for real estate transfers under Family Court orders or BFA's.

What we offer
We will:

prepare a transfer of land document for each property (transfer);
-
arrange for you and your partner to sign the transfer(s), ideally at the same time as any application for consent orders or binding financial agreement is signed;

attend to the payment of transfer duty (formerly known as stamp duty) and the endorsement of the transfer;
-
liaise with your financier and other parties as necessary for completion of registration at Landgate.
The above includes a reasonable allowance for correspondence and telephone calls. |

The following services are not included in the fixed-price; however, if you require them, we welcome the opportunity to give you an estimate of charges:

arranging the withdrawal or discharge of any encumbrances affecting the property;

locating or arranging production of any certificate of title; and

answering any requisitions issued by Landgate.
